1. Introduction and Acceptance

These Terms & Conditions ("Terms") constitute a legally binding agreement between you ("User," "you," "your") and Gaongram Tech Pvt Ltd ("Company," "we," "our," "us"), the operator of Animalsss, a Customer-to-Customer (C2C) online platform for buying and selling animals, livestock, pets, animal feed, agriculture products, and related items (the "Platform").

By accessing, registering on, or using the Platform in any manner — including browsing listings, creating an account, posting a listing, sending a message, making an offer, or any other interaction — you acknowledge that you have read, understood, and agree to be bound by these Terms in their entirety. If you do not agree to all of these Terms, you must immediately cease use of the Platform.

2. Definitions

For clarity, the following definitions apply throughout these Terms:

• "Platform" — The website animalsss.com, mobile application, and all related services, features, and subdomains operated by Gaongram Tech Pvt Ltd.
• "User," "You" — Any person or entity that accesses, registers on, or uses the Platform, whether as a buyer, seller, or visitor.
• "Seller" — A User who creates a listing to offer an animal, livestock, pet, feed, agriculture product, or related item for sale on the Platform.
• "Buyer" — A User who views listings, contacts sellers, makes offers, or purchases items through interactions initiated on the Platform.
• "Listing" — A post created by a Seller describing an item for sale, including details such as type, breed, age, price, description, images, and location.
• "Transaction" — Any agreement, sale, purchase, exchange, or transfer of goods between a Buyer and a Seller that results from interactions on the Platform.
• "C2C" / "Customer-to-Customer" — A platform model where transactions occur directly between Users. The Company is not a party to any transaction.
• "Content" — Any text, images, data, information, messages, or materials uploaded, posted, displayed, or transmitted by Users on the Platform.
• "Prohibited Item" — Any animal, product, or item that is illegal to trade, restricted by law, listed in our Prohibited Items policy, or violates these Terms (see Section 7).
• "Account" — A registered User profile on the Platform, created with a unique username, email address, and password.
• "Force Majeure" — Events beyond our reasonable control, including but not limited to natural disasters, war, terrorism, pandemics, government actions, internet outages, and cyber attacks.

3. Eligibility and Account Registration

3.1 Age Requirement

You must be at least 18 years of age (or the age of majority in your jurisdiction, whichever is higher) to create an account and use the Platform. By registering, you represent and warrant that you meet this age requirement. We reserve the right to terminate any account we believe is operated by a minor.

3.2 Account Registration

To access certain features of the Platform — including creating listings, sending messages, making offers, and participating in the community — you must create an account. During registration, you agree to:

• Provide accurate, current, and complete information about yourself.
• Maintain and promptly update your account information to keep it accurate and current.
• Choose a strong password and keep it confidential. You are solely responsible for all activity that occurs under your account.
• Not create more than one account per person, unless explicitly authorized by us in writing.
• Not use another User's account without their explicit permission.
• Not impersonate any person or entity, or falsely state or misrepresent your affiliation with any person or entity.
• Notify us immediately via our Contact Us form if you suspect any unauthorized use of your account or any breach of security.

3.3 Account Types

The Platform offers a single User account type. You may use the same account to both buy and sell. Commercial entities, farms, breeders, and businesses are welcome to register, provided they comply with all applicable laws and regulations for commercial animal trading in their jurisdiction.

3.4 Account Termination by User

You may delete your account at any time through your account settings. Upon deletion, your personal data will be processed in accordance with our Privacy Policy. Community contributions (forum posts, comments, Q&A) may remain in anonymized form. For any account-related issues, please contact us via our Contact Us form.

4. Nature of the Platform — C2C Marketplace

Specifically, the Company:

• Does NOT own, buy, sell, hold, possess, broker, or deal in any animals, livestock, pets, feed, agriculture products, or any other goods listed on the Platform.
• Does NOT inspect, verify, certify, examine, or evaluate the health, quality, pedigree, condition, temperament, or authenticity of any animal or product listed.
• Does NOT guarantee, warrant, or assure the accuracy, truthfulness, or completeness of any listing, seller information, or buyer information.
• Does NOT handle, process, escrow, or facilitate payments. All financial transactions are between the Buyer and Seller directly.
• Does NOT arrange, coordinate, or facilitate shipping, delivery, or transportation of animals or goods.
• Does NOT mediate, arbitrate, adjudicate, or resolve disputes between Users (though we may, at our sole discretion, assist in facilitating communication).
• Is NOT responsible or liable for any transaction outcome, including non-delivery, misrepresentation, quality issues, animal health, payment disputes, or any loss or damage arising from User-to-User interactions.

5. User Obligations and Conduct

As a User of the Platform, you agree to:

1. Comply with all applicable local, national, and international laws and regulations related to animal trading, animal welfare, import/export, transportation, and online commerce in your jurisdiction and the jurisdiction of the other party.
2. Provide truthful, accurate, and complete information in your profile, listings, and all communications on the Platform.
3. Use only images that you own or have the right to use for your listings and profile.
4. Treat all other Users with respect and professionalism. Harassment, abuse, threats, hate speech, discrimination, or any form of harmful behavior will result in immediate account suspension or termination.
5. Conduct transactions honestly and in good faith. Honor your commitments when you agree to buy or sell.
6. Report any violations of these Terms, suspicious activity, or fraudulent behavior to us promptly via our Contact Us form.
7. Ensure that any animal you list for sale is legally permitted to be sold in the relevant jurisdictions and that you have the legal right to sell it.

You agree NOT to:

1. List, sell, or offer any Prohibited Items (see Section 7).
2. Post false, misleading, deceptive, or fraudulent listings or information.
3. Use the Platform for any illegal, unauthorized, or prohibited purpose.
4. Upload viruses, malware, or malicious code, or attempt to disrupt, damage, or gain unauthorized access to the Platform's systems.
5. Scrape, crawl, or use automated tools to extract data from the Platform without our prior written consent.
6. Use the contact information obtained through the Platform to send spam, unsolicited marketing, or to harass other Users.
7. Attempt to circumvent any Platform features, restrictions, or security measures.
8. Engage in any activity that harms the reputation or operation of the Platform.

6. Listings — Rules and Guidelines

6.1 Creating a Listing

Sellers may create listings to offer animals, livestock, pets, feed, agriculture products, or related items for sale. Each listing must include accurate information about the item, including its type, breed, age, price, description, and images. You may upload up to 6 images per listing. Listings may be created as Single (one item) or Bulk (multiple units of the same item).

6.2 Listing Tiers

The Platform may offer different listing tiers (e.g., Standard, Featured, Urgent) with varying visibility levels. Any fees or conditions associated with listing tiers will be clearly disclosed at the time of listing creation.

6.3 Listing Content Rules

All listings must comply with the following rules:

• Images must be clear, recent, and accurately represent the item being sold. Do not use stock photos, images from the internet, or images that do not belong to you.
• The price listed must be the actual price you intend to sell at. Do not list placeholder prices (e.g., ₹1, ₹123) or deceptive pricing.
• The description must be truthful and complete. Do not omit material information about the animal's health, condition, or history.
• Each listing must be for a single item or a single bulk batch. Do not combine unrelated items in one listing.
• Listings must be placed in the correct category and subcategory.
• Do not include contact information (phone numbers, email addresses, social media handles, website URLs) in listing titles, descriptions, or images. Communication must start through the Platform's chat system.

6.4 Listing Moderation

We reserve the right, but do not assume the obligation, to review, approve, reject, edit, or remove any listing at our sole discretion, without prior notice. Listings that violate these Terms, applicable laws, or our content policies may be removed. Repeated violations may result in account suspension or termination.

6.5 Listing Duration

Listings remain active for the duration specified at the time of creation or until manually removed by the Seller. We reserve the right to set maximum listing durations and to automatically deactivate listings after a certain period.

7. Prohibited Items

The following items are strictly prohibited from being listed, sold, offered, or advertised on the Platform. Violation of this policy will result in immediate removal of the listing and may lead to account suspension or termination:

1. Endangered or Protected Species: Any animal listed under CITES (Convention on International Trade in Endangered Species) Appendix I, or otherwise classified as endangered or protected under national or international law, where trade is prohibited or requires permits that are not obtained.
2. Illegal Wildlife: Any wild animal whose capture, possession, sale, or trade is prohibited by applicable wildlife protection laws.
3. Stolen Animals or Property: Any animal or item that you do not have the legal right to sell.
4. Diseased or Unfit Animals: Animals known to have a contagious, infectious, or life-threatening disease that has not been disclosed in the listing.
5. Animals for Illegal Purposes: Animals intended for illegal fighting (dog fighting, cockfighting, etc.), illegal experimentation, or any other illegal purpose.
6. Human Beings or Human Remains: Absolutely prohibited.
7. Illegal Drugs, Narcotics, or Controlled Substances: Including veterinary drugs that require a prescription without proper authorization.
8. Weapons, Firearms, or Explosives: Any item designed to cause harm.
9. Counterfeit or Pirated Goods: Any item that infringes on intellectual property rights.
10. Hate Materials or Obscene Content: Any content that promotes hatred, violence, discrimination, or contains obscene material.

8. Intellectual Property Rights

8.1 Platform IP

The Platform, including its design, code, graphics, logos, trademarks, text, database, and all associated intellectual property, is owned by Gaongram Tech Pvt Ltd and protected by copyright, trademark, and other intellectual property laws. The names "Animalsss," "Animalsss," and associated logos are trademarks of Gaongram Tech Pvt Ltd. You may not use, copy, reproduce, modify, distribute, or create derivative works of any Platform content without our prior written permission.

8.2 User Content License

By uploading, posting, or submitting any Content (including listings, images, profile information, messages, forum posts, comments, and Q&A) to the Platform, you grant the Company a worldwide, non-exclusive, royalty-free, perpetual, irrevocable, sublicensable, and transferable license to use, reproduce, modify, adapt, publish, translate, distribute, and display such Content on the Platform and in connection with the operation, promotion, and improvement of the Platform. This license continues even after you delete your account for Content that remains part of community discussions (in anonymized form).

8.3 Your Ownership

You retain ownership of all Content you submit to the Platform. The license you grant us is solely for the purpose of operating, displaying, and promoting the Platform. You represent and warrant that you have all necessary rights to grant this license and that your Content does not infringe on any third-party intellectual property rights.

8.4 Copyright Infringement

If you believe your copyrighted work has been infringed on our Platform, please contact us via our Contact Us form with the following: (a) description of the copyrighted work, (b) URL of the infringing content, (c) your contact information, (d) a statement of good faith belief, and (e) a statement under penalty of perjury that you are authorized to act on behalf of the copyright owner.

9. Privacy and Data Protection

Your privacy is important to us. Our collection, use, storage, and sharing of your personal data is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Platform, you consent to the data practices described in our Privacy Policy.

We are committed to complying with all applicable data protection laws in the jurisdictions where we operate, including but not limited to GDPR (EU/UK), CCPA (California, USA), PIPEDA (Canada), DPDP Act (India), LGPD (Brazil), POPIA (South Africa), PDPL (Saudi Arabia), UAE Data Protection Law, and other applicable privacy regulations.

10. Disclaimers and Limitations of Liability

10.1 Platform Provided "AS IS"

THE PLATFORM IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, THE COMPANY DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ACCURACY OF INFORMATION.

10.2 No Guarantee of Transaction Outcomes

The Company does not guarantee, and makes no representations or warranties regarding: (a) the quality, safety, health, or legality of any item listed; (b) the truth or accuracy of any listing, User profile, or communication; (c) the ability of Sellers to sell or Buyers to pay; (d) that any transaction will be completed satisfactorily; or (e) the conduct of any User on or off the Platform.

10.3 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL GAONGRAM TECH PVT LTD, ITS DIRECTORS, OFFICERS, EMPLOYEES, AGENTS, AFFILIATES, OR SUBSIDIARIES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, LOSS OF DATA, LOSS OF GOODWILL, PERSONAL INJURY, PROPERTY DAMAGE, EMOTIONAL DISTRESS, OR ANY OTHER DAMAGES ARISING FROM:

• Your use of or inability to use the Platform.
• Any transaction between Users, including failed, fraudulent, or unsatisfactory transactions.
• Any dispute, disagreement, or conflict between Users.
• The health, death, injury, or damage caused by any animal purchased through connections made on the Platform.
• Any conduct, content, or communications of any User or third party on the Platform.
• Unauthorized access to or alteration of your data or transmissions.
• Any errors, omissions, or inaccuracies in any Content on the Platform.

In jurisdictions that do not allow the exclusion or limitation of certain warranties or liabilities, our liability is limited to the maximum extent permitted by law. If any liability is found despite these limitations, our total aggregate liability to you shall not exceed the greater of (a) the amount you paid to us in the 12 months preceding the claim, or (b) INR 1,000 (or equivalent in your local currency).

11. Indemnification

You agree to indemnify, defend, and hold harmless Gaongram Tech Pvt Ltd, its directors, officers, employees, agents, affiliates, and subsidiaries from and against any and all claims, demands, losses, damages, liabilities, costs, and expenses (including reasonable legal fees) arising out of or related to:

• Your use of or conduct on the Platform.
• Your violation of these Terms or any applicable law.
• Your Content, including any claims that your Content infringes on third-party rights.
• Any transaction you engage in as a Buyer or Seller.
• Any dispute you have with another User.

We reserve the right, at our own expense, to assume the exclusive defense and control of any matter subject to indemnification by you. You agree to cooperate with our defense of such claims. For legal notices, contact us via our Contact Us form.

12. Account Suspension and Termination

We reserve the right, at our sole discretion and without prior notice, to suspend, restrict, or terminate your account and access to the Platform (in whole or in part) for any reason, including but not limited to:

• Violation of these Terms or any Platform policy.
• Engaging in fraudulent, abusive, or illegal activity.
• Receipt of multiple credible complaints from other Users.
• Failure to comply with applicable laws.
• Any conduct that we believe, in our sole discretion, is harmful to the Platform, other Users, or our business interests.

Upon termination, your right to access and use the Platform ceases immediately. Provisions of these Terms that by their nature should survive termination — including but not limited to disclaimers, limitations of liability, indemnification, intellectual property licenses, and dispute resolution — shall survive.

13. Changes to These Terms

We reserve the right to modify, update, or replace these Terms at any time. When we make material changes, we will:

• Post the updated Terms on this page with a new "Last Updated" date.
• Display a prominent notice on the Platform for a reasonable period.
• Notify registered users through the Platform notification system or via email for significant changes.

Your continued use of the Platform after the effective date of any changes constitutes your acceptance of the modified Terms. If you do not agree to the changes, you must discontinue use of the Platform. We encourage you to review these Terms periodically.

14. Third-Party Links, Ads, and Services

The Platform may contain links to third-party websites, advertisements (including Google AdSense), and integrated services that are not owned or controlled by Gaongram Tech Pvt Ltd. We have no control over, and assume no responsibility for, the content, privacy policies, terms, or practices of any third-party websites or services. You access and use third-party services at your own risk. We encourage you to read the terms and privacy policies of any third-party service you interact with.

15. Reporting Violations and User Disputes

15.1 Reporting Violations

If you believe a User has violated these Terms, or if you encounter any prohibited content, fraudulent activity, abusive behavior, or any other issue on the Platform, please report it to us immediately. To report a violation, please use our Contact Us form with as much detail as possible (including relevant listing URLs, usernames, screenshots, and a description of the issue). We review all reports and take appropriate action.

15.2 Disputes Between Users

The Platform is designed to facilitate direct communication between Buyers and Sellers through our chat system. In the event of a dispute with another User, we encourage you to first attempt to resolve the issue directly through communication — this is the most efficient way to handle misunderstandings and reach a resolution.

16. Force Majeure

The Company shall not be liable for any failure or delay in performing its obligations under these Terms where such failure or delay results from any cause beyond our reasonable control, including but not limited to: acts of God, natural disasters, floods, earthquakes, fires, epidemics, pandemics, war, terrorism, riots, civil unrest, government actions, embargoes, strikes, labor disputes, internet or telecommunications failures, power outages, cyber attacks, or any other event of force majeure.

17. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, that provision shall be severed and the remaining provisions shall continue in full force and effect. The invalid provision shall be replaced by a valid provision that most closely matches the intent of the original provision.

18. Governing Law and Dispute Resolution

18.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of India, without regard to conflict of law principles, except where local consumer protection laws in your country of residence provide mandatory protections that cannot be waived.

18.2 Dispute Resolution

Any dispute, controversy, or claim arising out of or relating to these Terms, the Platform, or your use of the Platform shall first be attempted to be resolved through good-faith informal negotiations. If the dispute cannot be resolved informally within 30 days, it shall be resolved as follows:

• For Users in India: Disputes shall be subject to the exclusive jurisdiction of the courts in Lucknow, Uttar Pradesh, India.
• For Users Outside India: Disputes shall be resolved through binding arbitration administered by a recognized arbitration institution, with the seat of arbitration in Lucknow, Uttar Pradesh, India, and conducted in English. However, you retain the right to bring claims in your local courts where mandatory local consumer protection laws apply.

18.3 Class Action Waiver

TO THE MAXIMUM EXTENT PERMITTED BY LAW, YOU AGREE THAT ANY DISPUTE RESOLUTION PROCEEDINGS WILL BE CONDUCTED ONLY ON AN INDIVIDUAL BASIS AND NOT IN A CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION. YOU WAIVE ANY RIGHT TO PARTICIPATE IN A CLASS ACTION LAWSUIT OR CLASS-WIDE ARBITRATION.

19. Entire Agreement

These Terms, together with our Privacy Policy and any other policies or guidelines expressly incorporated by reference, constitute the entire agreement between you and Gaongram Tech Pvt Ltd regarding your use of the Platform and supersede all prior or contemporaneous agreements, communications, and understandings, whether written or oral.

No waiver of any provision of these Terms shall be deemed a further or continuing waiver of that provision or any other provision. Our failure to enforce any right or provision of these Terms shall not operate as a waiver of such right or provision.
